2.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access

We recommend using a strong, unique password and enabling any available security features.

2.3 Account Termination

You may delete your account at any time through your account settings. We may suspend or terminate your account for violations of these Terms or for prolonged inactivity.

3. Acceptable Use Policy

3.1 Permitted Use

You may use the Service only for lawful educational purposes in accordance with these Terms.

3.2 Prohibited Conduct

You agree NOT to:

• Share your login credentials with others
• Access another user's account without authorization
• Upload malicious software, viruses, or harmful code
• Attempt to circumvent security measures or assessment integrity features
• Use the Service for academic dishonesty, including cheating, plagiarism, or contract cheating

You agree to comply with your Institution's academic integrity policies. The Service includes features designed to detect and prevent academic dishonesty, including proctoring tools that monitor assessment sessions with your consent.

4. Content and Intellectual Property

4.1 Your Content

You retain ownership of Content you create and upload to the Service. By uploading Content, you grant us a non-exclusive, worldwide license to store, display, and process that Content as necessary to provide the Service.

4.2 Institution Content

Course materials, assessments, and other educational content provided by your Institution remain the property of your Institution or their respective owners. You may use such content only for your personal educational purposes.

4.3 Our Intellectual Property

The Service, including its design, features, and underlying technology, is owned by DiscoverNow Ltd and protected by intellectual property laws. You may not copy, modify, or create derivative works of the Service.

4.4 Feedback

If you provide feedback or suggestions about the Service, you grant us the right to use that feedback without restriction or compensation.

5. Privacy and Data Protection

Our collection and use of personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using the Service, you acknowledge that you have read and understood our Privacy Policy and consent to the collection and processing of your data as described therein.

6. Service Availability and Modifications

6.1 Availability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Service will meet your specific requirements
• The Service will be uninterrupted, timely, secure, or error-free
• The results obtained from using the Service will be accurate or reliable
• Any errors in the Service will be corrected

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DISCOVERNOW LTD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

Our total liability for any claims arising under these Terms shall not exceed the amount paid by your Institution for the Service during the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless DiscoverNow Ltd and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Content you upload or create through the Service

11. Dispute Resolution

11.1 Informal Resolution

Before initiating formal dispute resolution, you agree to contact us at legal@dnlearn.org to attempt to resolve any dispute informally.

11.2 Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.

11.3 Jurisdiction

Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales. However, this does not affect your statutory rights as a consumer to bring proceedings in your country of residence.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by:

• Posting a notice on the Service
• Sending an email to your registered address
• Updating the "Last Updated" date at the top of these Terms

Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
